Terms of Service

These Terms of Service set out the agreement between you and Britannia History Academy (we, our, us) for the provision and use of our online learning services, courses and associated resources. By enrolling on a course, using our site, or otherwise engaging our services you agree to be bound by these terms. If you are accepting these terms on behalf of an organisation you confirm you have appropriate authority to do so. Our objective is to provide an academically rigorous, accessible learning environment, and these terms describe the mutual responsibilities that support that aim. Please read them carefully. Definitions used in these terms: "Course" means any taught programme or module provided by us; "Learner" or "you" means a person enrolled on a Course; "Materials" means course content, recordings and source packs.

Enrolment, course access and licences

When you enrol in a Course you are granted a limited, non-transferable licence to access course Materials for personal, educational use for the duration of your enrolment. Access is provided following receipt of any required payment and successful registration. We reserve the right to refuse or cancel enrolment where information supplied is inaccurate, where a learner disrupts the learning environment, or where provision of services would breach applicable law. Courses may be delivered using recorded lectures, live seminars, online forums and downloadable source packs. Access to live seminar slots may be limited and some elements may be delivered in scheduled cohorts; we will provide a timetable and reasonable notice of scheduled sessions. Learners must use their own accounts responsibly, protect login details and not share access. Any misuse of course Materials beyond permitted personal study (including unauthorised copying, redistribution or commercial use) is prohibited. For institutional or group licences different terms may apply and will be set out in a separate written agreement.

Fees, payment and refund policy

Course fees, membership charges and any applicable taxes will be stated at the point of purchase. Payment must be made by the methods published on our site or by agreement in writing. Where payment is not received on time we may suspend access until outstanding fees are settled. Refunds are provided only as set out in this clause and our published refund schedule. For standard short courses paid in advance, learners may be eligible for a full refund up to 14 days before course start, subject to any promotional terms. After course start refunds are limited and may be pro rata where materials have been accessed and tuition delivered; in some cases a workshop or administration fee may be retained. For longer pathways or bespoke agreements refund terms are described in the enrolment documentation. To request a refund contact [email protected] with your enrolment details. We process refunds to the original method of payment and may require reasonable verification. We do not accept liability for payment card provider charges or bank fees associated with transfers; these remain the responsibility of the payer unless otherwise agreed.

Intellectual property and permitted use

All course Materials, trademarks and site content are owned or licensed by Britannia History Academy and are protected by copyright and other intellectual property laws. Learners are permitted to use Materials for private study and academic purposes but may not reproduce, republish, distribute, sell or publicly perform Materials without prior written permission. Tutors retain moral and academic attribution for their work; learners must cite sources and respect academic integrity when submitting assignments. Where third-party materials are provided under licence we will observe the licensor's terms and may ask learners to agree to additional conditions. If you believe your intellectual property rights have been infringed by content on our site, contact us at [email protected] and provide sufficient details for us to investigate. We will act promptly to address substantiated notices in accordance with applicable law.

Liability, disclaimers and indemnity

We aim to provide accurate, carefully prepared teaching and learning materials. However, the Materials are provided on an "as available" basis and do not constitute professional advice. To the fullest extent permitted by law, Britannia History Academy excludes liability for indirect, incidental, special or consequential losses, including loss of profit, loss of business or reputational loss arising from use of our services. Our total aggregate liability for direct losses caused by our negligence is limited to the fees paid by the learner for the specific Course in the 12 months preceding the event giving rise to the claim. Learners must indemnify the Academy against claims arising from their misuse of Materials, breach of these Terms or unlawful conduct when participating in seminars or forums. Nothing in these Terms excludes liability for death or personal injury resulting from negligence or any liability that cannot be excluded by law. For consumer learners, your statutory rights are not affected by these Terms.

Changing services, suspension and termination

We may modify or withdraw Courses, Materials or features of the site from time to time. Where changes materially affect an ongoing Course we will inform enrolled learners promptly and endeavour to provide reasonable alternatives or adjusted schedules. We may suspend access to services for maintenance, security reasons or where required by law. If a learner seriously breaches these Terms or behaves in a way that disrupts others we may suspend or terminate access without refund at our discretion. For cancellations initiated by the Academy of an entire Course we will offer a suitable alternative, transfer of fees to another Course, or a refund in accordance with the refund policy. We are not responsible for failures by third-party services outside our control. Where possible we provide notice of scheduled maintenance and recommend learners retain copies of any personal notes they create during a Course.

Governing law and dispute resolution

These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms will, where possible, be addressed through good-faith discussions between the parties. If the dispute cannot be resolved informally, the parties may agree to mediation before commencing legal proceedings. Subject to the above, the courts of England and Wales will have exclusive jurisdiction over any dispute that is not resolved by mediation. For learners resident in Scotland or Northern Ireland local procedural rules and jurisdictional options apply; however the substantive law governing these Terms remains the law of England and Wales unless otherwise required by mandatory consumer protection rules.
